Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is concluded electronically between the SELLER and the BUYER identified below, pursuant to Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts. The BUYER declares having read and accepted this Agreement and the preliminary information before placing an order.

Buyer
The natural person who provides their name, email, phone, and (for physical delivery) address in the order form ("BUYER"). The information provided at the time of ordering prevails.
2. Subject of the Agreement
The subject of this Agreement is the sale and delivery of custom-made biometric/ID photo products (digital file and/or printed photos) ordered by the BUYER electronically on vesikalik.com.tr, whose characteristics and sales price are stated in the order summary, together with the parties' rights and obligations.
3. Product and Price Information
The product type (digital file / print), photo size, number of sheets, unit price, delivery fee, and the total sales price including all taxes are displayed in the summary step of the order wizard and in the order confirmation email. Published prices remain valid until updated; the price confirmed at the time of ordering applies.
4. Payment
- Bank transfer/EFT: Made to the bank account stated on the order confirmation screen and email. The order number must be written in the transfer description; the order enters production once the SELLER confirms the payment.
- Credit card: Collected through the iyzico secure payment infrastructure; card details are neither viewed nor stored by the SELLER. The order enters production once the payment is completed successfully.
Orders whose payment is not completed within 7 days may be cancelled.
5. Delivery
- Digital file: Made available for download from the order page in the BUYER's account after payment confirmation. Digital delivery is deemed performed when the download links are made accessible to the BUYER.
- Cargo: The product is produced and handed to the contracted cargo company after payment confirmation. Delivery shall in no case exceed the statutory 30-day period. The cargo fee and any free-shipping threshold are stated in the order summary.
- Courier: In served areas, next-day delivery is targeted for orders whose payment is confirmed before the announced cutoff time.
Delivery is made to the address given in the order form. The BUYER is responsible for delays and damages caused by incorrect or incomplete address details.
6. Right of Withdrawal and Exceptions
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for the following products:
- Custom-made products (Art. 15/1-c): Printed ID photos are produced specifically for the BUYER from their own photo, in the size and quantity they selected, and are therefore excluded from the right of withdrawal.
- Services performed instantly in electronic media and intangible goods delivered instantly (Art. 15/1-ğ): The digital photo file is an intangible good delivered instantly once the download links are made accessible after payment confirmation, and is therefore excluded from the right of withdrawal. The BUYER acknowledges having been informed of this during the ordering step and having given explicit consent that no withdrawal right will exist once delivery begins.
These exceptions do not affect your statutory rights in case of a defective product (see Section 7).
7. Defective Products and Refunds
If a printed product arrives damaged, misprinted, or different from the order, the BUYER may notify [email protected] with photos within a reasonable time after delivery. Once the defect is established, the SELLER will, at the BUYER's choice, reprint and reship free of charge or refund the price. Refunds are made via the original payment method within 14 days at the latest.
8. Force Majeure
Performance of obligations may be suspended in events beyond the parties' control such as natural disasters, fire, epidemics, infrastructure and communication failures, or legislative changes; in such cases the parties shall inform each other within a reasonable time.
9. Personal Data Protection
Detailed information on personal data processed in connection with orders is provided in the Privacy Policy and the GDPR Notice.
10. Dispute Resolution
For disputes arising from this Agreement, Consumer Arbitration Committees at the BUYER's or SELLER's place of residence are competent within the monetary limits announced annually by the Turkish Ministry of Trade, and Consumer Courts for disputes exceeding those limits.
11. Entry into Force
The Agreement is concluded when the BUYER completes the ordering process and confirms the payment obligation. The order summary and this Agreement are sent to the BUYER in the order confirmation email and remain accessible from the BUYER's account.
